End User License Agreement
1. Agreement
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Tuger Inc ("Company," "we," "us," or "our"), located at 8 The Green, Dover, DE 19901, United States, for the use of the PetSOS mobile application ("App").
By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the App.
2. License Grant
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on mobile devices that you own or control
- Use the App for your personal, non-commercial purposes
3. License Restrictions
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Remove or alter any proprietary notices or labels
- Use the App for any commercial purpose without our written consent
- Use the App in any way that violates applicable laws
- Transfer the App or this license to another party
4. Intellectual Property
The App, including all content, features, and functionality, is owned by Tuger Inc and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
This EULA does not grant you any rights to our trademarks, service marks, or logos.
5. User Content
You retain ownership of any content you create or upload through the App (pet profiles, photos, notes). By using the App, you grant us a license to use this content solely for providing and improving the Service.
6. Third-Party Services
The App may integrate with third-party services (Google Maps, authentication providers, payment processors). Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services.
7. Updates and Modifications
We may release updates, patches, or new versions of the App. Some updates may be required for continued use. We reserve the right to modify, suspend, or discontinue the App at any time without notice.
8. Subscription Services
Certain features require a paid subscription. Subscriptions are processed through the Apple App Store or Google Play Store and are subject to their terms. See our Terms of Service for subscription details.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be error-free, secure, or available at all times.
11. Medical Disclaimer
The App provides general pet care information and is NOT a substitute for professional veterinary advice, diagnosis, or treatment. Always seek the advice of a qualified veterinarian with any questions regarding your pet's health.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUGER INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold harmless Tuger Inc from any claims, damages, or expenses arising from your use of the App or violation of this EULA.
14. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies.
We may terminate this EULA at any time for any reason.
15. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce.
16. U.S. Government End Users
The App is a "commercial item" as defined in 48 C.F.R. §2.101, and is licensed to U.S. Government end users only as a commercial item and with only those rights as are granted to all other end users under this EULA.
17. Governing Law
This EULA shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
18. Dispute Resolution
Any disputes arising from this EULA shall be resolved through binding arbitration in Delaware, USA, in accordance with the American Arbitration Association rules.
19. Severability
If any provision of this EULA is found unenforceable, the remaining provisions will remain in full force and effect.
20. Entire Agreement
This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Tuger Inc regarding the App.
