1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Tuger Inc ("Company," "we," "us," or "our"), located at 8 The Green, Dover, DE 19901, United States, governing your use of the PetSOS mobile application and website (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
PetSOS is a pet health management platform that provides:
- Location-based veterinary clinic finder
- Pet profile and health record management
- Vaccination tracking and reminders
- Personalized pet care tips and advice
- Favorite clinic management
- Customer support services
3. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
4. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscriptions and Payments
5.1 Free and Premium Plans
PetSOS offers both free and premium subscription plans. Premium features include unlimited pet profiles, breed-specific care tips, and exclusive discounts.
5.2 Billing
Premium subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to their respective terms and payment policies.
5.3 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your device's app store settings.
5.4 Refunds
Refund requests are handled by Apple or Google according to their refund policies. We do not process refunds directly.
6. User Content
You retain ownership of content you submit (pet photos, notes, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for providing the Service.
You are responsible for ensuring you have the right to submit any content and that it does not violate any laws or third-party rights.
7. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems to access the Service without permission
- Transmit viruses, malware, or other harmful code
- Harass, abuse, or harm other users
- Submit false or misleading information
8. Medical Disclaimer
IMPORTANT: PetSOS is not a substitute for professional veterinary care. The information provided through our Service, including care tips and health information, is for general educational purposes only.
- Always consult a licensed veterinarian for medical advice
- Do not delay seeking veterinary care based on information from our Service
- In emergencies, contact your nearest emergency veterinary clinic immediately
We do not endorse any specific veterinary clinic or guarantee the accuracy of third-party clinic information.
9. Third-Party Services
Our Service integrates with third-party services including Google Maps, Apple/Google authentication, and payment processors. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
10. Intellectual Property
The Service and its original content (excluding user content), features, and functionality are owned by Tuger Inc and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- Clinic information is accurate or up-to-date
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUGER INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold harmless Tuger Inc and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.
You may terminate your account at any time by contacting us or using the account deletion feature.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
16. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall take place in Delaware, USA. You waive any right to participate in class action lawsuits.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and Tuger Inc regarding the Service.
